A decision on an Art. 59 UPCA / R. 190 RoP evidence-production application is an appealable privileged order subject to a 15-day appeal period, whether the application is granted or dismissed and whether the ruling is issued separately or included in the decision in the main proceedings.

The appeal period is a mandatory time limit that cannot be extended, but an excusable error may justify a derogation in exceptional circumstances where the court caused confusion and the party acted in good faith with the diligence required of a normally well-informed person.

After the applicable classification has been clarified, an incorrect indication of the appeal period for a privileged order is insufficient by itself to constitute exceptional circumstances where a representative exercising all due care should have known that the period was 15 days after service.

The Court of Appeal must examine compliance with the appeal time limit ex officio, and registry completion or validation of formal requirements does not finally establish compliance with all applicable procedural requirements.

A substantially identical R. 190 RoP evidence-production application that was filed and decided in substance at first instance cannot be treated on appeal as a request not previously submitted; refiling is admissible only if justified by new facts that could not reasonably have been available during the first-instance proceedings.

Appellate objections and subsequent case-law developments concerning the legal principles applicable to evidence production are not new facts that justify refiling a substantially identical R. 190 RoP application on appeal.
