Under Rule 265 RoP, the Court may permit withdrawal of proceedings in accordance with the parties’ mutual agreement and declare the withdrawn proceedings closed.

No decision on costs is required where the actions are withdrawn in their entirety and all parties declare that a cost decision is not requested.

On applications under Rule 370.11 RoP in conjunction with Rule 370.9(b) RoP, the Court may determine proportional reimbursement of court fees and award the stated proportion of the fees paid for the relevant proceedings.
